Procedure for handling ARCO rights requests

ARTICLE 1.- OBJECTIVE 

The purpose of this document is to inform employees, former employees, applicants, suppliers and third parties of the procedure that will be followed in the case of a request made by any natural person who requires exercising the rights of Access, Rectification, Cancellation or Opposition (ARCO), regarding the Personal Data and/or Sensitive Data of which they are the Owner and which is contained in the Personal Data Banks owned by MINERA BATEAS SAC.

ARTICLE 2.- LEGITIMACY OF THE EXERCISE 

Holders may access ARCO rights over their personal information deposited in the Personal Data Banks managed by MINERA BATEAS SAC , for which they must submit an application with the following requirements: 

1. The Holder of the Personal Data must address himself directly in person or electronically to MINERA BATEAS SAC , proving your identity and presenting a copy of the National Identity Document. 

2. In the case of representation of the Owner of Personal Data, the situation must be accredited attaching a power of attorney with a legalized signature. 

3. The Data Subject shall indicate the specific request that gives rise to the application. 

ARTICLE 3.- FORMAT FOR EXERCISE OF ARCO RIGHTS 

The request must be addressed to the Person in Charge of MINERA 's Personal Data Banks. BATEAS SAC , the following information must be provided: 

1. Names and surnames of the Holder of the right and accreditation thereof (by means of DNI), and In the case of your representative, the same (DNI), plus the document that accredits him as such. 2. Specific request that gives rise to the application. 

3. Address and/or email address, indicating where you wish to be notified with the response. 4. Date and signature of the applicant. 

5. Documents supporting the request, if applicable. 

ARTICLE 4.- TERMS 

MINERA BATEAS SAC must respond to the requests within the following deadlines: 

1. The maximum response time of MINERA BATEAS SAC to the exercise of the right of information will be 08 (eight) days counted from the day following the presentation of the application.

The printing of this document is considered an uncontrolled copy, except for those that are properly identified. Current versions of the documents are available on the Minera Bateas internal network.

2. The maximum response time of the Person in Charge of Personal Data Banks to the exercise of the right of Access, will be 20 (twenty) days counted from the day following the submission of the request by the Personal Data Holder. 

If the request is accepted and MINERA BATEAS SAC does not accompany its response with the requested information, access will be effective within ten (10) days following said answer. 

3. The maximum response time of the Person in Charge of Personal Data Banks to the The exercise of the right of Rectification, Cancellation or Opposition will be 10 (ten) days counted from the day following the submission of the corresponding application. 

ARTICLE 5.- REQUEST FOR ADDITIONAL INFORMATION 

If the information provided in the application is insufficient or erroneous in such a way that does not allow its attention, MINERA BATEAS SAC may require within 07 (seven) days following receipt of the request, additional information to the Owner of the Personal Data to attend to the request. 

Within a period of 10 (ten) days after receiving the request, the Holder will accompany the additional documentation that you deem relevant to support the request. In case Otherwise, the application will be considered as not submitted. 

ARTICLE 6.- COST OF APPLICATION PROCESSING

The exercise of ARCO rights by the holder of personal and/or sensitive data is free of charge. The application and processing are free of charge.

ARTICLE 7.- ADMINISTRATIVE INSTANCE – GENERAL DIRECTORATE OF PROTECTION OF PERSONAL DATA

In the event that the response is totally or partially negative on the part of MINERA BATEAS SAC and this is not duly justified, the Owner of the Personal Data has the right to appeal to the General Directorate of Personal Data Protection (DGPDP) for a claim, under the terms established by the Personal Data Protection Law, Law No. 29733, its regulations and complementary norms, to exercise their ARCO rights.

In order to be assisted by the DGPDP and initiate the protection procedure, the Personal Data Owner must first have appealed to MINERA BATEAS SAC and obtained a totally or partially negative response from it within the time periods provided and indicated in this document, since it is an essential requirement to request protection from the DGPDP that the request has previously been submitted to the Owner of the Personal Data bank.
